Nice Stretch
Chris Harbinson sues Outsports.com for defamation, saying the posting of his photograph -- taken prior to the 2004 LA Marathon and published without a caption -- caused "damage to his name and reputation."
If they ran captions what should the captions say? Aren't marathons considered a news event? But does that standard change when the publication is a niche publication? It will be interesting to see how this plays out in the courts.
